BIN RENTAL TERMS & CONDITIONS
By placing an order with BinWise Disposal (“Company”), you (“Customer”) acknowledge and agree to the following terms and conditions:
1. Rental Agreement
- The Customer is renting a bin for waste disposal purposes only.
- The Customer assumes full responsibility for the bin from the time of delivery until pickup.
- The Company reserves the right to refuse service or remove the bin at any time if terms are violated.
2. Payment & Additional Charges
- Payment is required upon booking unless otherwise stated.
- Additional charges apply for:

- Exceeding weight limits
- Extra rental days beyond the agreed period
- Restricted or blocked pickup access
- Disposal of prohibited or hazardous materials
- Damage, loss, or theft of the bin
- The Customer authorizes the Company to charge any applicable fees using the payment method on file.
3. Bin Use & Customer Responsibilities
- The bin must not be overfilled; materials must be level with the top edge.
- The Customer must not dispose of:

- Hazardous or toxic materials (e.g., chemicals, batteries, asbestos)
- Flammable substances (e.g., gasoline, propane tanks)
- Electronics, tires, or prohibited waste per local regulations
- No Unauthorized Bin Movement: The bin must not be moved by the Customer or any third party. Only the Company is authorized to relocate the bin. Any unauthorized movement that results in damage or access issues will result in additional fees.
- No Mechanical Loading or Compacting: The Customer must not use heavy machinery, compactors, or mechanical equipment to load or compress materials inside the bin. Doing so may cause damage and result in additional fees or liability.
- The bin must be placed on a stable, accessible surface; the Company is not responsible for surface damage (driveways, lawns, sidewalks, etc.).
- The Customer is responsible for ensuring a clear, unobstructed pickup area. Any failed pickup attempts will result in additional charges.
4. Company Responsibilities
- The Company will deliver and retrieve the bin as scheduled.
- The Company disposes of waste in compliance with local and environmental regulations.
5. Liability & Indemnification
- The Company is not responsible for:

- Damage to driveways, lawns, underground utilities, or other surfaces due to normal bin placement or removal.
- Injuries or damages caused by misuse of the bin.
- The Customer assumes full liability for any damage, injuries, or legal consequences resulting from their use of the bin.
- The Customer agrees to indemnify and hold the Company harmless from any claims, fines, or legal actions arising from improper use or placement of the bin.
6. Cancellations & Modifications
- Cancellations must be made within the required notice period to avoid cancellation fees.
- The Company reserves the right to modify these terms at any time, with updated terms applying to all future rentals.
7. Force Majeure (Uncontrollable Events)
The Company is not liable for delays or failures in service due to unforeseen circumstances, including but not limited to:
- Severe weather conditions
- Natural disasters (floods, earthquakes, wildfires, etc.)
- Road closures or government restrictions
- Labor strikes or supply chain disruptions
In such cases, the Company reserves the right to reschedule or cancel services without penalty.
8. Disclaimer of Warranties
The Company provides bin rental services “as is” and “as available” without any warranties, express or implied. The Company does not guarantee:
- Uninterrupted or error-free service
- That the bin will be suitable for specific waste disposal needs beyond general use
The Customer assumes all risks associated with bin use.
9. Limitation of Liability
- The Company’s total liability for any claims, including damages, shall not exceed the total rental fee paid by the Customer.
- Under no circumstances shall the Company be liable for indirect, incidental, or consequential damages, including lost profits, business interruptions, or property damage beyond the bin placement area.
10. Governing Law & Dispute Resolution
- This Agreement shall be governed by the laws of [Your Province/State].
- Any disputes shall first be attempted to be resolved through mediation. If mediation fails, disputes shall be settled through arbitration or small claims court, depending on the nature of the claim.
- The Customer waives their right to file a class action lawsuit against the Company.
11. Right to Refuse Service
The Company reserves the right to refuse service to any Customer who:
- Provides false or misleading information
- Violates these Terms & Conditions
- Engages in threatening, abusive, or fraudulent behavior toward Company representatives
12. No Modification Without Written Consent
No verbal modifications to this Agreement are valid. Any changes must be agreed upon in writing by both the Customer and the Company.
13. Severability Clause
If any part of this Agreement is deemed invalid or unenforceable by a court, the remaining provisions shall continue to be in full effect.
14. Acknowledgment of Understanding
By placing an order, the Customer acknowledges they have read, understood, and agreed to these Bin Rental Terms & Conditions and are legally bound by them.
